1. Nature of the Service

The nis2-model ("the Tool") is an open-source software that provides automated, preliminary analysis of potential NIS2 Directive applicability based on user-provided parameters.

2. Not Legal Advice

The Tool does NOT provide legal advice. All outputs — including applicability classifications, obligation listings, sanction calculations, and compliance reports — are generated by deterministic software logic and represent the Tool's automated classification, not a legal opinion.

The Tool's outputs:

• Do not constitute legal, regulatory, or professional advice of any kind
• Do not replace consultation with a qualified legal professional
• Should not be relied upon as the sole basis for compliance decisions
• May not reflect all applicable exceptions, national transpositions, or sector-specific rules

3. Limitations

The Tool evaluates a subset of the NIS2 Directive (EU 2022/2555):

• Covered: Articles 2, 3, 20, 21, 23, 34 (applicability, obligations, sanctions, incident reporting)
• Not covered: Articles 7-9, 13-14, 26-29, 32-33, 35 and other provisions
• Not covered: National transposition laws (e.g. D.Lgs. 138/2024 in Italy) — only the EU Directive
• Simplified: Size thresholds use a simplified model; linked/partner enterprise rules per EU Recommendation 2003/361/EC are not implemented
• Simplified: Sub-sector classification is accepted but not used in the decision logic

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE AUTHORS AND CONTRIBUTORS PROVIDE THE TOOL "AS IS" WITHOUT WARRANTY OF ANY KIND. IN NO EVENT SHALL THE AUTHORS BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY ARISING FROM THE USE OF THE TOOL OR ITS OUTPUTS.

Users who rely on the Tool's outputs without independent legal verification do so at their own risk.

The source code is licensed under EUPL-1.2. This is a copyleft license — derivative works must be released under EUPL-1.2 or a compatible license.
